Civil Litigation

The firm's Commercial Litigation practice includes all aspects of litigation in state and federal courts. Our lawyers have tried numerous cases to verdict and compete favorably with the largest firms in the country. Firm lawyers have represented clients in a wide range of complex litigation matters in state and federal courts and have brought a number of cases to trial, including jury trial. With many years of experience representing corporate clients, our lawyers provide practical advice to in-house counsel seeking to maximize results, while keeping legal costs to a minimum.

 

We have special expertise in the energy, telecommunications and water industries, and public utility law, and have handled a broad range of civil litigation matters relating to the public utility industries.

 

We also have special expertise in disputes that arise in debtor-creditor relationships, including enforcement of creditors' rights, litigation relating to secured transactions, and the defense of lender liability, truth-in-lending, and securities fraud claims. Our clients benefit from the combination of our litigation experience with our commercial finance and bankruptcy expertise, and we have represented debtors and creditors in preference transfer litigation, and objections to claims.

 

The firm's lawyers also have particular expertise in creditor's rights, including writs of attachment and writs of possession, and enforcement of judgments. We have substantial experience in real property receivers and judicial foreclosures, mechanic's liens and title insurance issues.

 

Other special areas of expertise include breach of contract law, insurance law, and intellectual property law. We also defend clients in consumer class actions involving unfair competition and unfair business practices claims brought under California Business & Professions Code Section 17200 and antitrust claims brought under the Cartwright Act and under the federal antitrust laws. And we defend clients with respect to environmental causes of action, such as toxic tort actions and actions under California 's Proposition 65, the Porter-Cologne Act, the California Environmental Quality Act, and the Safe Drinking Water Act.

Regulatory Litigation

 

Our Regulatory Litigation practice involves proceedings before state and federal agencies, including compliance filings, enforcement proceedings, investigations, complaint proceedings, certificate applications, ratesetting proceedings, rulemakings, industry-wide investigations, and appeals arising from such proceedings. We have particular expertise in representing parties before the California Public Utilities Commission. We are well equipped to handle regulatory proceedings before state and federal agencies relating to air and water quality, and we are expert in matters such as renewable energy, climate change, broadband, "green" water systems, and energy and water conservation.

 

Appellate Litigation

 

Our Appellate Litigation practice involves representing clients in writs, appeals and in some cases lawsuits challenging and defending the actions of administrative agencies and courts. Our experienced appellate lawyers have argued numerous cases before the California Court of Appeal, the California Supreme Court, the United States Court of Appeals and the United States Supreme Court. And our appellate lawyers have clerked on federal appellate courts, have written and spoken extensively on issues of appellate practice, and have served as contributing authors to learned treatises on the subject.
